Authorization
I hereby authorize Quigley Heating and Air Conditioning to perform scheduled charges from the indicated credit card or bank account and I will not dispute the charges if they are in accordance with what is included in this contract. I agree that this is a continuing periodic charge beginning on the start date that continues monthly or annually for the debit amount indicated on this contract through the life of the credit card on file. I understand that to terminate the recurring billing process I need to send written correspondence via email to customerservice@quigleyac.com, I must either cancel this contract by paying the cancellation fee or arrange for an alternative method of payment. Cancellation fees will be prorated based on seasonal inspections performed prior to the cancellation.
I agree to notify Quigley Heating and Air Conditioning of any changes to my bank account or credit card. I understand that cancellations or changes to my auto-debit program must be made in writing attention: Customer service, and sent in to 13720 Diplomat Dr, Farmers Branch, TX 75234, faxed to 214.521.7305, or emailed to customerservice@quigleyac.com. Quigley reserves the right to make changes to this auto debit program with 30 days advanced notice.
Leaks and Filter Changes
Quigley Heating and Air Conditioning is not responsible for the damage caused by condensate leaks. Q Club Members are responsible for changing their filters on a regular basis during months when service is not scheduled. Please consult your technician if you have any questions regarding how often your filter should be changed. Special filter sizes may incur a surcharge as only cases can be ordered. Please ask your service technician for special filter pricing if you do not have standard size filters. Standard filter sizes are: 20x25x1, 16x25x1, 20x20x1, and 16x20x1. Non-standard size filters can be purchased in quantities of 12 and must be stored at Member's home.
Unsatisfactory Service
Quigley Heating and Air Conditioning reserves the right to reject any agreement if upon inspection by the service technician, the equipment is found to be in such a condition that service will be unsatisfactory to both parties. If the service is unsatisfactory to the client, the client is entitled to a partial refund, pro-rated by the value of the visit or a second inspection performed by a supervisor. The customer needs to notify Quigley Heating and Air Conditioning of unsatisfactory service within ten days of the unsatisfactory service.
Scheduling
Quigley Heating and Air Conditioning will attempt to notify the customer once by telephone or email when it is time to schedule a visit. If the phone call and emailed reminder are unreturned after ten days, Quigley Heating and Air Conditioning reserves the right to cancel that season's maintenance visit Members are responsible for updating contact information by email (customerservice@quigleyac.com) or by calling the office.
Automatic Renewals and Cancellations
The agreement will automatically be renewed each year on the anniversary date of the agreement. Quigley Heating and Air Conditioning reserves the right to adjust the continuing periodic charge on the anniversary date of each year to reflect increases in costs or inflation. Such adjustments shall be based upon actual increases in costs of labor, materials, utilities and overhead. Adjustment for inflation shall be based upon the CPI-U increase for the previous year. Cancellations must be made by giving 30 days’ written notice to customerservice@quigleyac.com or by mail to 13720 Diplomat Dr Farmers Branch, TX 75234.
Warranties and Limitations
Except as expressly warranted herein, the services are provided "as is," without warranties, express or implied, including without limitation any warranty of merchantability or fitness for a particular purpose.To the maximum extent permitted by applicable law, in no event shall Quigley, its directors, officers, shareholders, employees. Representatives or agents be liable for any consequential, incidental, indirect, special, punitive, or exemplary damages (including loss of use) arising out of this Agreement, or the services performed, including without limitation Quigley Heating and Air Conditioning's own negligence. THE SOLE AND EXCLUSIVE REMEDY FOR YOU IS A REFUND OF THE AMOUNTS PAID UNDER THIS AGREEMENT THAT ARE SPECIFIC TO YOUR ISSUE WITH THE SERVICES PROVIDED (OR NOT PROVIDED) AS A RESULT OF YOUR MEMBERSHIP. in no event shall Quigley's liability from all causes of action of any kind exceed the total amount paid or payable to Quigley under this agreement.
Emergency
Status Quigley Heating and Air Conditioning will make every possible effort to schedule and service each planned service customer within 24 hours of a reported emergency. Emergencies are defined as the following: 1) Customers with one unit and no air conditioning or no heating 2) Customers with HVAC related water leaks and 3) Customers with one unit working, at least one other unit not operating, but extenuating circumstances exist such as health risks for customers present in the area that is not cooling or heating.
Client Acknowledgment
The client has read this document and has had the opportunity to ask any questions before signing. The client’s signature acknowledges that the client has read and understands, and the client has been advised to keep a copy of the document if signed up with a technician.
If client signed up over the phone with a customer service agent, client agreed on recorded phone call to the terms and conditions and received a copy via email provided on customer’s account.
This agreement contains the entire understanding and agreement between the parties hereto with respect to the services to be provided by Quigley and supersedes any prior or contemporaneous written or oral agreements, representations, or warranties respecting the subject matter hereof. This agreement may be amended only in writing signed by you and an authorized representative of Quigley.
